1. Purpose of the residence permit
In Germany you can take the opportunity to complete vocational training and prepare yourself as well as possible for the job market. You have the choice between school-based or company-based training. For both options it may be necessary to apply for a residence permit according to Section 16a of the Residence Act.
2. Requirements
In order to be granted a residence permit in Germany, a vocational training or school contract must be available as proof of the training place. Qualified vocational training requires a minimum of 2 years and must lead to a state-recognized degree. The residence permit is usually granted for the duration of the desired vocational training.
For the purpose of vocational training, German language skills at level B1 of the Common European Framework of Reference for Languages are usually required. An exception to this is only possible if the training institution grants individual language support during the training or confirms that the language skills are sufficient to complete the qualified vocational training.
The livelihood must be secured during the training from your own funds or from third parties. At least EUR 903.00 per month must be available for this (current value for the year 2023). In the case of school-based training, financial proof can be provided by opening a blocked account or by submitting a declaration of commitment. Since the company training is remunerated, the salary specified in the training contract is sufficient as proof of financial resources. If the training allowance you are aiming for is not sufficient, you can make up the difference by providing evidence of a blocked account or by submitting a declaration of commitment.
The granting of a residence permit for vocational training is usually subject to the approval of the Federal Employment Agency. It examines two aspects: whether the trainee is hired under the same conditions as German trainees and whether another person - from Germany or the EU - is suitable for this position. This check is called the priority check. If no person is suitable for the position, the exam is considered passed.
3. Specifics
If you are completing qualified in-company vocational training, your residence permit in accordance with Section 16a, Paragraph 1, Clause 3 of the Residence Act allows you to attend a preparatory, job-related German course. This allows you to improve your German skills in a targeted manner.
What do I have to consider after completing my professional training?
As soon as you have successfully completed your vocational training, you can stay in Germany for up to 12 more months to find a job that corresponds to your vocational training. For this you need a residence permit to look for a job according to § 20 Abs. 3 Nr. 3 AufenthG. You apply for this at the immigration office responsible for you. During your job search in Germany, you can do any job that is necessary to secure your livelihood. As soon as you have found a job for which you are qualified, you can apply for a residence permit for qualified employment (§ 18a AufenthG) without having to leave Germany.
